End User License Agreement
The license that governs how you may install, access, and operate the APB360 application.
● In Plain Language
This summary is provided for convenience only. It is not part of the agreement, and the full text below governs.
- You get a license, not the software. We license APB360 to you for your own operational use; we keep ownership of the software itself (Section 1).
- A person drives the software. Bots, scrapers, headless browsers, RPA, and screen-automation tools may not navigate the Application or submit its forms. Integrations go through the API instead (Section 3).
- Assistive technology is welcome. Screen readers, voice control, switch access, and magnification are expressly permitted — the automation restriction is not aimed at accessibility (Section 3).
- Your records stay yours. This license does not change who owns your data (Section 5).
- Credentials are per person. Named users, not shared logins — the audit trail depends on it (Section 4).
- Alabama law governs. Disputes are handled under the laws of the State of Alabama (Section 12).
- The Terms of Service still apply. This EULA sits alongside them and covers the software license specifically (below).
◆ Agreement to This License
This End User License Agreement (this “EULA”) is a binding agreement between you — the individual or the entity on whose behalf you act (“you”) — and GunTRAC LLC (“APB360”, “we”, “us”, “our”).
In this EULA, the “Application” means the APB360 software we make available to you, including the browser and mobile clients, any locally installed component, and any update, patch, or new release of it. The “Site” means apb360.com, my.apb360.com, and any successor site. The “API” means the programming interface at api.guntrac.com. Together these are the “Services”.
By installing, accessing, logging into, or otherwise using the Application, you accept this EULA and agree to be bound by it. If you do not agree, do not install or use the Application. If you are accepting on behalf of an agency, department, or company, you represent that you have authority to bind that organization, and “you” means that organization.
Relationship to the Terms of Service
This EULA governs the software license specifically. The APB360 Terms of Service govern your broader relationship with us — fees, data ownership, privacy, API use, warranties, liability, and dispute resolution — and are incorporated into this EULA by reference. Read the two together. If they conflict on a matter of the software license, this EULA controls; on any other matter, the Terms of Service control. Where you and APB360 have signed a separate written agreement, purchase order, or contract-vehicle terms covering the same subject matter, that signed agreement controls to the extent of any conflict.
Changes to this EULA
We may revise this EULA from time to time. If we do, we will make reasonable efforts to notify you by email at the address in your registration information or by posting a notice in the Application. The “last updated” date above always reflects the current version. Your continued use of the Application after a revision takes effect constitutes your acceptance of it. If you do not accept a revision, stop using the Application and cancel your account as described in the Terms of Service.
1. License Grant
Subject to your compliance with this EULA and the Terms of Service, and to payment of all applicable fees, APB360 grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Application for your own internal business or agency operations for the duration of your subscription or license term.
The license is granted for the number of named users, agencies, locations, or other units of measure identified in your order, quote, or subscription plan. Use beyond those quantities requires an additional license.
The Application is licensed, not sold. Except for the rights expressly granted here, APB360 and its licensors reserve all right, title, and interest in and to the Application, the Site, the API, and all related software, documentation, designs, and intellectual property. Nothing in this EULA transfers ownership of any of it to you, and no rights are granted by implication, estoppel, or otherwise.
2. License Restrictions
You may not, and may not permit anyone else to:
- copy, modify, adapt, translate, or create derivative works of the Application, except as strictly necessary for its normal operation;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, or underlying ideas of the Application, except to the extent that restriction is prohibited by applicable law;
- rent, lease, lend, sell, resell, sublicense, distribute, assign, host, or otherwise make the Application available to any third party, or use it to operate a service bureau or timesharing arrangement;
- remove, obscure, or alter any copyright, trademark, or other proprietary notice in the Application or its output;
- circumvent, disable, or interfere with any licensing, authentication, security, rate-limiting, monitoring, or access-control feature of the Application;
- access the Application to build, or to assist anyone in building, a competing product or service, or to benchmark or publish performance results without our prior written consent;
- use the Application in a way that impairs its functionality, degrades its performance, or interferes with any other customer's use of it;
- attempt to gain access to any data, account, or system you have not been expressly authorized to reach; or
- use the Application in violation of any applicable law or regulation, or of the rights of any person.
3. Automated Access, Robots, and Screen Automation
The Application and the Site are licensed for operation by a human being, working through a supported browser or client. Records in APB360 — bound-book entries, custody transfers, qualification results, inventory counts, and reconciliation actions — are relied on as an accurate account of what a specific, identified person did and when. Automated interaction breaks that attribution and can silently corrupt an audit trail that a regulator, an Industry Operations Investigator, or a court may later examine. This Section exists to protect the integrity of your own records.
Prohibited automation
You may not use, deploy, or permit any of the following against the Application or the Site:
- Robots and crawlers — any robot, bot, spider, crawler, scraper, harvester, or similar automated agent to access, navigate, index, monitor, or extract data from the Application or the Site;
- Browser automation — any headless browser or browser-automation framework, including without limitation Selenium, WebDriver, Puppeteer, Playwright, Cypress, and equivalent tooling, used to drive the Application or the Site;
- Screen automation and RPA — any robotic process automation, screen-scraping, screen-automation, UI-automation, macro-recording, or keystroke- or click-injection tool used to navigate the Application, operate its controls, or read data off its screens;
- Automated form submission — any script, browser extension, overlay, plug-in, or agent that automatically completes, submits, or resubmits any form in the Application or on the Site, including registration, login, contact, request, inventory, custody, qualification, reconciliation, and bound-book entry forms;
- Autonomous agents — any autonomous or semi-autonomous software agent, including an artificial-intelligence agent that operates a browser or user interface on your behalf, used to take actions in the Application;
- Control circumvention — any means of defeating, bypassing, or automatically answering a CAPTCHA, bot-detection challenge, rate limit, session timeout, or other access control; and
- Bulk automated activity — creating accounts, generating records, or transmitting requests in bulk by automated means.
What is permitted
This Section is not intended to restrict legitimate integration or accessibility. The following are expressly permitted:
- The API. Programmatic access belongs on the API, not on the user interface. Use the documented API with valid credentials, subject to Section 7 of the Terms of Service. If the API does not yet expose something you need, contact us rather than automating the interface.
- Assistive technology. Screen readers, voice-control and speech-recognition software, switch access, screen magnification, alternative input devices, and other assistive technology used by an individual to operate the Application are permitted without restriction. Nothing in this Section limits the use of accessibility tools, and we will not treat their use as a violation.
- Ordinary browser features. Built-in browser password managers and autofill for your own credentials and contact details, and standard accessibility and reader features of your browser or operating system.
- Search indexing. Search-engine crawlers accessing the public marketing site to the extent permitted by our
robots.txt. Nothing in this exception permits crawling of my.apb360.com or of any authenticated area. - Anything we authorize in writing. If you have an automation need that does not fit the above, email help@apb360.com. We grant written exceptions where the use case is sound.
Monitoring and enforcement
We may use technical measures to detect automated traffic, and we may throttle, challenge, block, suspend, or terminate access that we reasonably believe violates this Section, with or without notice. You are responsible for all automation operated under your credentials, whether by you, your personnel, a contractor, or a third-party tool you have connected, to the same extent as if you had operated it yourself. Records created in violation of this Section may be flagged, quarantined, or reversed, and we are not responsible for any resulting gap in your recordkeeping.
4. Accounts, Credentials, and Authorized Users
Access credentials — passwords, API keys, tokens, and single sign-on configuration — are issued to a named individual and are not to be shared. The value of a chain-of-custody record depends on it identifying a real person, so shared or generic logins are not permitted except for service accounts we issue for API use.
You are responsible for keeping credentials confidential, for all activity conducted under them, and for the acts and omissions of every person to whom you grant access to your account, including staff, armorers, instructors, advisors, and contractors. You must notify us promptly at help@apb360.com of any unauthorized use or suspected compromise. Credentials remain our property and may be revoked as described in the Terms of Service.
You must be at least eighteen (18) years old to use the Application.
5. Your Data and Ownership
This EULA does not change who owns your records. The asset records, inventory counts, bound-book entries, qualification and training records, maintenance history, and chain-of-custody entries you enter into the Application remain yours, as described in Sections 4 and 5 of the Terms of Service. We take only the limited license we need to operate the Services for you.
You are responsible for the accuracy and lawfulness of the data you enter, for maintaining your own copies of it, and for determining whether the Application meets your regulatory recordkeeping obligations. You may export your records using the export features in the Application at any time during your term.
6. Updates, Releases, and Support
The Application is delivered as a hosted service and is updated continuously. We may add, change, or remove features, and we may deploy updates, patches, and new releases without notice. Updates are governed by this EULA unless we provide separate terms with them. You may be required to accept an update in order to keep using the Application, and we do not support indefinitely running an older version.
Support is provided at the level described in your subscription plan or signed agreement. This EULA does not itself obligate us to provide support, maintenance, training, or any particular level of availability.
7. Term and Termination
This EULA takes effect when you first install or use the Application and continues for as long as you have a valid subscription or license term, unless terminated earlier.
You may terminate at any time by ceasing use of the Application and cancelling your account; you remain responsible for fees through the balance of the then-current billing period. We may suspend or terminate this EULA and your license immediately if you materially breach it — including any violation of Section 2 or Section 3 — or as otherwise permitted by the Terms of Service.
On termination, your license ends immediately and you must stop using the Application. Export your records before termination takes effect; contact help@apb360.com if you need assistance producing a complete export. Sections 5, 8, 9, 11, and 12, and any representation or warranty you make in this EULA, survive termination.
8. Warranty Disclaimer
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND YOUR USE OF IT IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APB360, ITS SUBSIDIARIES AND AFFILIATES, AND THEIR THIRD-PARTY PROVIDERS, LICENSORS, DISTRIBUTORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, SECURE, OR FREE FROM BUGS, VIRUSES, DATA LOSS, ERRORS, OR DESTRUCTION.
APB360 DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT YOUR USE OF THE APPLICATION WILL SATISFY OR ENSURE COMPLIANCE WITH ANY LEGAL OBLIGATION, LAW, OR REGULATION. THE APPLICATION IS A RECORDKEEPING TOOL; RESPONSIBILITY FOR REGULATORY COMPLIANCE REMAINS WITH YOU.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER APB360 NOR ANY OF ITS AFFILIATES, SUBSIDIARIES, OR SUPPLIERS WILL BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE THE APPLICATION.
IN NO EVENT WILL THE AGGREGATE LIABILITY OF APB360 ARISING OUT OF OR RELATING TO THIS EULA OR THE APPLICATION EXCEED THE COMPENSATION YOU PAID FOR ACCESS TO OR USE OF THE APPLICATION DURING THE THREE MONTHS PRECEDING THE DATE OF THE CLAIM.
The indemnity in Section 13 of the Terms of Service applies to this EULA and is incorporated here by reference.
10. Government and Agency Users
The Application is “commercial computer software” and its documentation is “commercial computer software documentation” as those terms are used in 48 C.F.R. 12.212 and 48 C.F.R. 227.7202. Consistent with those provisions, United States Government end users acquire the Application with only those rights set out in this EULA and the Terms of Service.
State and local government agencies, and other public entities, acquire the Application under this EULA except where applicable law or a signed contract vehicle requires otherwise; in that case, the terms required by law or by the signed contract vehicle control to the extent of the conflict. See Purchasing & Contracts for the contract vehicles we support.
11. Export and Regulatory Compliance
You may not use, export, re-export, or transfer the Application except as authorized by United States law and the laws of the jurisdiction in which it was obtained. You represent that you are not located in, and are not a national or resident of, any country subject to a United States embargo, and that you are not on any United States government list of prohibited or restricted parties.
You are solely responsible for your own compliance with the federal, state, and local laws and regulations governing your operations, including those administered by the Bureau of Alcohol, Tobacco, Firearms and Explosives. The Application helps you keep records; it does not make regulatory determinations on your behalf.
12. General
This EULA is governed by the laws of the State of Alabama and the federal laws of the United States applicable therein, without regard to conflict-of-laws principles. The dispute resolution, arbitration, and venue provisions in Section 15 of the Terms of Service apply to any dispute arising out of or relating to this EULA and are incorporated here by reference.
If any provision of this EULA is held unlawful, void, or unenforceable, that provision is severable and the remaining provisions stay in force. Our failure to enforce any provision is not a waiver of it. APB360 may assign this EULA to any party without your consent; you may not assign it without our prior written consent, and any attempted assignment without it is void.
This EULA, together with the Terms of Service and any signed agreement, purchase order, or contract-vehicle terms between us, is the entire agreement regarding your license to the Application and supersedes all prior communications on that subject. This EULA and all documents relating to it, including notices, have been and will be drawn up in the English language only.
